Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and obses (pre-launch) (“obses”, “we”, “us”) and govern your access to and use of the obses mobile app, website at obses.in, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. What obses is

obses is a technology platform that lets customers (“Customers”) discover and book appointments with independent beauty and grooming professionals — including in nails, hair, skin, makeup, and related categories — and studios (collectively, “Professionals”). Professionals are independent third parties; they are not employees, agents, or partners of obses. obses does not itself provide beauty, grooming, or wellness services. The contract for any service performed is between the Customer and the Professional.

2. Eligibility & accounts

You must be at least 18 years old and capable of forming a binding contract under Indian law to use the Service. You agree to provide accurate information when creating your account and to keep it up to date. You are responsible for activity on your account and for keeping your login credentials secure. Notify us immediately at help@obses.in if you suspect unauthorised access.

3. Bookings, payments & cancellations

• Booking. When you book a service, you make an offer to the Professional. A booking is confirmed once the Professional accepts it through the Service. Prices and service details are set by the Professional.
• Payment. Before sending a request, you pay one amount through Razorpay, the “held fee”: the Professional’s appointment fee, if they have set one, or, for a come-to-me request to a Professional who has not set an appointment fee, their home-visit fee in its place. If neither applies, nothing is paid in advance. The held fee holds your slot and is credited against your bill. Everything else — the service price and, for a come-to-me booking, a home-visit fee that was not held — is paid directly to the Professional on the day. The price shown beforehand is an estimate from the Professional’s menu; what you finally agree with them is between you and them, and obses is not a party to that payment.
• Customer cancellations. If you withdraw a request before the Professional accepts it, the held fee is refunded in full. Once the booking is confirmed, an appointment fee is retained by the Professional whenever you cancel; a home-visit fee held in its place is refunded in full if you cancel 24 hours or more before the appointment starts, and retained by the Professional if you cancel later. A reschedule carries the held fee to the new time. A payment taken for a request you did not finish sending is refunded in full.
• Professional cancellations. If the Professional declines your request, cancels a confirmed booking, or does not respond before the request expires, the held fee is refunded in full.
• No-shows and refunds. If you do not attend a confirmed booking, the held fee is retained by the Professional. Approved refunds are returned to the original payment method; provider and bank processing times may delay when they appear.

4. Your conduct

You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose.
• Harass, threaten, or discriminate against any Professional, Customer, or obses staff.
• Make fake bookings, manipulate ratings or reviews, or impersonate another person.
• Reverse engineer, scrape, or attempt to gain unauthorised access to the Service or its underlying systems.
• Upload content that infringes the rights of others or is defamatory, obscene, or otherwise objectionable.
• Contact other users for any purpose other than completing or discussing a booking made through the Service.

We may suspend or terminate accounts that violate these Terms.

5. Professional-specific terms

If you register as a Professional, you additionally agree that:

• You operate independently and are solely responsible for the services you provide, including hygiene, safety, qualifications, tax compliance, and any required licences or registrations under applicable health, cosmetology, and consumer protection laws.
• Content you publish (portfolio photos, descriptions, pricing) is accurate, not misleading, and yours to publish or appropriately licensed.
• You will honour confirmed bookings and communicate professionally with Customers.
• You choose your appointment fee and your home-visit fee, and authorise obses to collect the held fee described in Section 3 from Customers on your behalf and to apply it as described in Section 6. Any other amount a Customer pays you is collected by you directly, and you are responsible for it.

6. Fees charged to Professionals

Listing on obses is free. obses charges Professionals a platform fee of ₹200 for each completed appointment booked through the Service.

• Completed appointments. An appointment counts as completed once its scheduled end time has passed, unless you record in the app, within the window shown there, that the Customer did not attend or did not pay. obses tells the Customer the outcome you record and may ask them to confirm it.
• Set off against the held fee. Where the Customer prepaid a held fee for that booking, the platform fee is taken from it first. Any remainder is credited to your obses balance; if the held fee was less than the platform fee, the difference is added to what you owe.
• Settlement. Your balance and statement are shown in the app’s dashboard, and you pay what you owe there through Razorpay. obses does not make payouts to Professionals: Customers pay you directly for the service, and obses bills you its fee. A credit balance is applied against your future platform fees and is not paid out.
• Unpaid balances. We may pause new bookings for your account while a balance remains unpaid. Changes to the platform fee are made under Section 12.

7. Content & intellectual property

You retain ownership of content you upload to the Service. By uploading, you grant obses a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and adapt that content for the purpose of operating, promoting, and improving the Service. The obses name, logo, designs, and software are owned by obses and may not be used without our prior written permission.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, obses disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. obses does not warrant the quality, safety, or legality of any service performed by a Professional, the accuracy of listings, or that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, obses and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from your use of the Service. obses’s aggregate liability for any claim relating to the Service is limited to the greater of (a) the fees you paid to obses in the six months preceding the claim, or (b) INR 5,000.

10. Indemnity

You agree to indemnify and hold obses harmless from any claim, liability, loss, or expense (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party right.

11. Suspension & termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if necessary to protect the Service or its users. Sections that by their nature should survive termination will do so.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you through an in-app notice, push notification, or another channel available for your account. Continued use of the Service after the updated Terms take effect constitutes acceptance.

13. Governing law & disputes

These Terms are governed by the laws of India, without regard to its conflict of laws principles. Subject to applicable law, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms or the Service.
